Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Travina platform at travina.co (the “Platform”), operated by Travina LLC (“Travina,” “we,” “us,” or “our”). By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Platform.
1. The Platform
Travina is a private, vetted network that connects two types of professional Users:
- Travel Advisors — travel professionals who book travel for clients.
- Property Managers — owners and managers of vacation rental properties.
The Platform allows approved Users to browse listings, communicate with each other, and arrange vacation rental bookings.
Travina is not a booking, payment, or escrow platform. Travina does not facilitate, process, or hold any payments related to bookings, commissions, deposits, or rental income. All bookings, contracts, payments, and commission arrangements are made directly between travel advisors and property managers, outside the Platform.
2. Eligibility and Account Registration
2.1 Eligibility
To use the Platform, you must:
- Be at least 18 years old
- Be authorized to do business in the United States
- For travel advisors: be a licensed or credentialed travel professional actively representing clients
- For property managers: own, manage, or be authorized to list the properties you submit
- Successfully complete Travina’s application and manual approval process
Travina reserves the right to approve, deny, or revoke access at its sole discretion.
2.2 Account Registration
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for:
- Maintaining the confidentiality of your username and password
- All activity that occurs under your account
- Notifying Travina immediately of any unauthorized access or security breach
You may not share your account credentials or transfer your account to anyone else.
3. Subscription and Payment (Property Managers Only)
3.1 Subscription Fees
Property managers must maintain an active subscription to access the Platform. Subscription fees, plans, and billing terms are described at the time of purchase. All subscription fees are non-refundable except as required by law.
3.2 Billing
By starting a subscription, you authorize Travina (and its payment processor) to charge your designated payment method on a recurring basis until you cancel. Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
3.3 Failed Payments
If a payment fails, Travina may suspend your access to the Platform until payment is received.
3.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Platform until that date.
3.5 Price Changes
Travina may change subscription pricing with advance notice. Price changes will not affect your current billing period but will apply at your next renewal.
4. Travel Advisor Access
Travel advisors may use the Platform without paying a subscription fee. Travina reserves the right to introduce fees or paid tiers in the future, with advance notice.
5. The Travina Pledge
All Users agree to the Travina Pledge, which sets out the professional standards every member commits to. Violations of the Pledge may result in suspension or termination.
6. Bookings, Contracts, Payments, and Commission
This section is critical. Please read it carefully.
6.1 Travina’s Role Is Limited
The Platform is a venue for travel advisors and property managers to find each other and communicate. Travina is not a party to any booking, rental agreement, contract, payment, commission arrangement, or any other transaction between Users. Travina does not:
- Process, hold, or transmit any booking payments, deposits, rental income, or commissions
- Set, negotiate, or guarantee commission rates
- Ensure, collect, or guarantee payment of any commission owed between Users
- Issue contracts between travel advisors and property managers
- Verify the financial standing, solvency, or trustworthiness of any User beyond initial application review
- Confirm or guarantee property availability
- Verify or guarantee the accuracy, completeness, or currency of any listing or property information
- Inspect, manage, or oversee any property
- Manage any guest relationship, check-in, check-out, or guest experience
6.2 User-to-User Responsibility
All contracts, payments, commissions, deposits, refunds, cancellations, taxes, and any other financial or contractual matters are solely the responsibility of the travel advisor and the property manager. Both parties are responsible for their own:
- Booking terms and conditions
- Payment collection and processing
- Commission agreements and timely payment
- Cancellation and refund policies
- Compliance with state, federal, and local laws (including Seller of Travel registration where applicable, tax collection, occupancy taxes, and consumer protection laws)
- Insurance, indemnification, and liability arrangements
6.3 Guest Experience
Travina is not responsible for the guest experience. This includes, without limitation, the condition of any property, accuracy of listings, property amenities, cleanliness, safety, accessibility, guest behavior, neighbor issues, local regulations, or anything that occurs before, during, or after a guest’s stay.
6.4 Disputes Between Users
Travina does not adjudicate disputes between travel advisors and property managers. If a dispute arises — including disputes about bookings, commissions, cancellations, property condition, or guest behavior — Users are responsible for resolving it directly. Travina may, at its sole discretion, suspend or terminate accounts of Users involved in repeated disputes or violations of the Pledge.
6.5 Listing Accuracy
Property managers are solely responsible for the accuracy, completeness, and currency of their own listings, including descriptions, photos, pricing, availability, amenities, and policies. Travina does not create, verify, or guarantee listing content and is not responsible for any errors, omissions, outdated information, or other inaccuracies in any listing or property information. Travel advisors are responsible for confirming all listing details directly with the property manager before relying on them.
6.6 Commissions
Travina is not responsible for any unpaid, late, partial, miscalculated, or disputed commissions. Commission terms are set and agreed directly between the travel advisor and the property manager, and the collection and payment of commissions is solely their responsibility. Travina does not guarantee that any commission will be paid and has no obligation to collect, enforce, or mediate any commission owed between Users.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Misrepresent your identity, credentials, or affiliation
- List properties you are not authorized to list
- Solicit Users for purposes unrelated to vacation rental bookings
- Attempt to circumvent the Platform’s vetting process
- Scrape, copy, or harvest data from the Platform
- Upload malicious code, attempt to disrupt the Platform, or compromise its security
- Harass, threaten, or abuse other Users
- Violate any applicable law or regulation
Travina may suspend or terminate accounts that violate these Terms.
8. User Communications
All communications between Users are expected to be professional and consistent with the Travina Pledge. Travina may store, review, and use communications as described in the Privacy Policy.
Users should not share sensitive personal information — such as Social Security numbers, full payment card details, or government-issued ID numbers — through Platform messages.
9. Listings and User Content
9.1 License to Travina
When you submit content to the Platform — including listings, photos, descriptions, messages, application materials, and reviews — you grant Travina a non-exclusive, worldwide, royalty-free license to use, host, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.
9.2 Accuracy
You represent that any content you submit is accurate, that you have the right to submit it, and that it does not infringe on any third party’s rights.
9.3 Removal by Travina
Travina may remove any listing, property, content, or User from the Platform at any time, with or without notice, for any reason or no reason, including content that violates these Terms or the Pledge, or that we determine, in our sole discretion, is inappropriate.
9.4 Removal by Property Managers
Property managers may remove their own listings from the Platform at any time through their account settings or by contacting Travina. Removal of a listing does not entitle the property manager to any refund of subscription fees already paid, which remain non-refundable except as required by law, and does not affect any commitments or arrangements already made directly with a travel advisor.
10. Intellectual Property
The Platform — including software, design, logos, trademarks, and all content other than User-submitted content — is owned by Travina or its licensors and is protected by intellectual property laws. You may not copy, modify, or reuse any part of the Platform without our express written permission.
11. Account Termination
Travina may suspend or terminate your account, or remove any of your listings or properties, at any time, with or without notice, for any reason, including violation of these Terms, the Privacy Policy, or the Pledge. You may close your account at any time through your account settings or by contacting us.
Upon termination:
- Your access to the Platform ends immediately
- Property manager subscriptions are non-refundable for the current billing period
- Provisions of these Terms that by their nature should survive (including Sections 6, 12, 13, 14, and 15) will continue to apply
12. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TRAVINA MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Without limiting the foregoing, Travina does not warrant that:
- The Platform will be uninterrupted, error-free, or secure
- Any listings, properties, or User information are accurate, complete, or reliable
- Any User will perform their obligations to another User
- Any specific booking, commission, or revenue outcome will result from using the Platform
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVINA AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF TRAVINA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TRAVINA’S TOTAL CUMULATIVE LIABILITY TO ANY USER, FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TRAVINA IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
14. Indemnification
You agree to indemnify, defend, and hold harmless Travina and its officers, employees, and affiliates from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Platform
- Your violation of these Terms, the Privacy Policy, or the Pledge
- Your interactions, contracts, or disputes with other Users
- Any content you submit
- Your violation of any law or third-party right
15. Dispute Resolution and Governing Law
15.1 Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles.
15.2 Informal Resolution
Before bringing any formal claim, you agree to contact Travina at leigh@travina.co and attempt to resolve the dispute informally for at least 30 days.
15.3 Arbitration
Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Palmetto, GA. You and Travina waive any right to a jury trial.
15.4 Class Action Waiver
You and Travina agree that any dispute will be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative action.
15.5 Exceptions
Either party may bring claims in small claims court or seek injunctive relief in court for intellectual property infringement.
16. General
- Entire Agreement. These Terms, together with the Privacy Policy and the Pledge, are the entire agreement between you and Travina.
- Changes. Travina may update these Terms from time to time. We will post the updated version and update the “Last Updated” date. Continued use after changes means you accept them.
- Severability. If any provision is found unenforceable, the rest will remain in effect.
- No Waiver. Travina’s failure to enforce any provision is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. Travina may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. Travina may give notices through the Platform or by email to the address on your account.
